TEMPORARY HELP AGENCY AND DIRECTOR FINED $150,000 TOTAL FOR FAILING TO PAY WAGES

Description of Offence: 12066424 Canada Inc. failed to comply with an Order to
Pay wages, contrary to section 103(8)of the Employment Standards Act, 2000 (ESA). Son-Van Duong failed to comply with
a Director’s Order to Pay wages, contrary to section 106of the ESA. These are offences under sections 132and 136of
the ESA.

Date of Offence: Summer and fall of 2023

Date of Conviction: April 23, 2026

Penalty Imposed:

* Following an ex parte trial in Windsor Provincial Offences Act Court, Justice
of the Peace Holly DeBacker convicted both defendants. 12066424 Canada Inc.
was fined $100,000 and Son-Van Duong was fined $50,000. Crown Counsel was
Jamie Chiang.
* The court also imposed a 25 per cent victim fine surcharge as required by the
Provincial Offences Act. The surcharge is credited to a special provincial
government fund to assist victims of crime.

Background:

* In early 2023, an Employment Standards Officer with the Ministry of Labour,
Immigration, Training and Skills Development conducted an investigation into
12066424 Canada Inc. after the ministry received complaints about the
company. The investigation identified contraventions of the ESA, including
unpaid minimum wage entitlements and termination of assignment pay.
* The officer then conducted an audit of the employer’s records for 2022, which
determined that hundreds of employees were owed wages, including regular
wages, public holiday pay and vacation pay. The wages owed totalled
$234,212.47.
* As a result, on June 29, 2023, the officer issued an Order to Pay to 12066424
Canada Inc. The order required the company to repay wages owed to employees
plus administrative costs.
* The company did not pay the order and did not apply for a review to the
Ontario Labour Relations Board within the required time.
* On August 3, 2023, the officer issued a Director’s Order to Pay wages to the
company’s director, Son-Van Duong. This order made the director personally
responsible for a portion of the unpaid wages.
* The director did not pay the order and did not apply for a review.
* Failing to comply with an Order to Pay wages or a Director’s Order to Pay
wages is a violation of the Employment Standards Act, 2000.
